Thank you for participating in the alpha testing of Neo Browser, Gen Digital’s next-generation browser. Your use of Neo Browser (“Technology”) is subject to the terms and conditions outlined below:
Provision of Technology "As Is": Neo Browser is provided to you on an "as is" and "as available" basis without any express, implied, or statutory warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Gen Digital disclaims all liability related to your use of the Technology to the fullest extent permitted by law.
No Liability: Gen Digital shall not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages, arising out of or in connection with your use of the Technology, even if advised of the possibility of such damages. This includes, without limitation, damages resulting from errors, omissions, interruptions, defects, or delays.
Feedback License: By providing feedback, suggestions, or other input related to Neo Browser (“Feedback”), you grant Gen Digital a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, distribute, perform, and display the Feedback for any purpose, including but not limited to improving and marketing the Technology.
Data Use: Gen Digital may collect, use, and analyze data arising from your use of Neo Browser (“Data”) for any purpose, including but not limited to product improvement, development of new features, and marketing. By using Neo Browser, you consent to such collection and use of Data. Any data collected will be handled in compliance with applicable privacy laws, such as the General Data Protection Regulation (GDPR) or the California Consumer Privacy Act (CCPA), where applicable.
Confidentiality: Neo Browser and any associated documentation or communications are considered confidential information of Gen Digital. You agree not to disclose or share any information about the Technology with third parties without Gen Digital’s prior written consent.
Compliance with Laws: Your use of Neo Browser must comply with all applicable laws and regulations. You agree not to use the Technology in a manner that infringes on the rights of any third party or violates any applicable laws.
Reservation of Rights: Gen Digital retains all right, title, and interest in and to Neo Browser, including all intellectual property rights. Your use of the Technology does not grant you any ownership or other rights beyond the limited testing access provided herein.
Limitation of Use: Your use of Neo Browser is strictly limited to this alpha testing phase and for the purposes specified by Gen Digital. Any other use of the Technology is prohibited.
Use at Gen Digital’s Discretion: Your access to and use of Neo Browser is provided solely at Gen Digital’s discretion, and Gen Digital reserves the right to modify, restrict, or terminate such access at any time.
Age Restriction: Neo Browser is not intended for use by individuals under the age of 18. By using Neo Browser, you confirm that you are at least 18 years old.
Feature Availability Notice: Some advanced Neo Browser features, including those powered by local LLMs, may not be available on all devices due to hardware and software limitations. Core browsing remains unaffected, but certain AI tools may have limited functionality.
Governing Law: This disclaimer shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.
Forum Selection: You agree that any disputes arising out of or related to this disclaimer or your use of Neo Browser shall be resolved exclusively in the federal courts located in California.
Termination: Gen Digital reserves the right to terminate your access to Neo Browser at any time for any reason or no reason.
